Responsibilities of a member to obtain legal assistance
The following matters do not require prior approval of the Board of Directors,
however, a member must contact the President or Vice President responsible
for legal assistance to obtain a tracking number before contacting the law
firm of Lyon, Gorsky, Haring & Gilbert LLP In all other cases,
the member must obtain the approval of the Board of Directors before the
legal assistance will be paid by the DPA:
Administrative investigations conducted by the Dallas Police Department
and the City of Dallas and its appointed boards and commissions
The administrative appeal of any disciplinary action or accident review
board.
Legal defense through arraignment in criminal investigations of alleged
misconduct which arise our of the performance of the member's sworn police
functions or which allege acts of misconduct during the member's shift
of duty.
Legal defense through trial in criminal prosecutions of alleged acts
of misconduct involving the use of force or the use of a motor vehicle
which arise out of the performance of the member's sworn police functions.
Legal advice to a deceased member's immediate survivors relating to
benefits available under federal, state, or local law in cases resulting
in the death of a member while that member was performing their sworn
police functions or during the member's shift of duty.
Worker's compensation matters which, in the opinion of DPA legal counsel,
necessitates the use of an attorney.
One hour of legal advice relating to any job related matter.
